外国工作者的社会保险Social Insurance for Foreign Workers

外国人在中国境内就业的,参照中国法律规定参加社会保险。随着一项新规定的生效,在华外籍工人已纳入中国的社会保障体系。特别是对于一些超龄在中国工作的外国员工,公司在为其办理工作许可证时就需要承诺为外国人购买保险。

Foreigners who obtain employment in China shall participate in social insurance with reference to the provisions of Chinese laws. Foreign workers in China have been included in the country’s social security system as a new regulation takes effect. Especially for some overage foreign employees working in China, companies need to promise to buy insurance for foreigners when they apply for work permits for them.

根据人力资源和社会保障部于2011年9月6日公布出台的《在中国境内就业的外国人参加社会保险暂行办法》,直接受雇于中国境内用人单位的外国人,以及与境外雇主订立雇用合同后,被派遣到在中国境内的分支机构、代表机构(以下简称“境内工作单位”)工作的外国人,都将参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险。社保费用由外国人与中国境内用人单位(或境内工作单位)按照相关规定共同缴纳。但是,具有与中国签订社会保险双边或者多边协议国家国籍的人员在中国境内就业的,其参加社会保险的办法按照协议规定办理。

According to the Ministry of Human Resources and Social Security announced on 6th Sep. 2011 of the employment of foreigners in China to participate in Social Insurance Interim Measures, unit of choose and employ persons of foreigners employed in China directly, and with overseas employers hire contract later, were sent to the branches and representative offices in China (hereinafter referred to as “domestic work unit”) foreigners working, will attend the worker is basic endowment insurance, worker is basic medical treatment insurance, inductrial injury insurance, unemployment insurance and maternity insurance. The social security fee shall be jointly paid by the foreigner and the employing unit (or the domestic working unit) in China in accordance with relevant regualations. However, if a person with the nationality of a state that has signed a bilateral or multilateral social insurance agreement with China finds employment in China, the measures for his participate in social insurance shall be handled in accordance with the provisions of the agreement.

凡在中国境内持有有效工作许可的注册外籍职工,包括在中国境内注册的中资企业、外资企业、社会团体、律师事务所、会计师事务所、基金会的外籍职工,以及境外注册公司派驻中国的外籍职工享受与中国公民类似的退休、医疗、工伤、失业和生育福利。

Anyone who hold a valid work permit in China the registration of foreign workers, including registered within the territory of China of Chinese enterprises and foreign enterprises, social organizations, law firm, accounting firm, the foundation of foreign workers, as well as overseas registered company in China of the Chinese and foreign citizens of worker enjoys similar retirement, medical treatment, inductrial injury, unemployment and maternity benefits.

Inclusion in the scheme would mean less take-home pay for foreign workers, since some of their wages would go to pension funds and their employers would have to pay more.

Workers and employers also share the cost of medical and unemployment insurance, but employers are responsible for work-related injury insurance and maternity insurance.would have to pay more.

Many foreign workers welcomed the move and said joining the social security program would help them work and live safer and more comfortable in China.

Rising costs are a big problem for employers.

人力资源和社会保障部社会保障中心副主任徐延军表示,与中国签订了社会保险协议的国家的工人可以免缴部分费用。

Xu Yanjun, Deputy Director of the Social Security Center of the Ministry of Human Resources, said workers in countries that have signed social insurance agreements with China can avoid paying some of the costs.

北京首都经济贸易大学的社会保障专家卢学静说,中国应该与更多的国家谈判并签署社会保险协议,以避免外国工人被双重收费,并更好地保护他们的权利。

Lu Xuejing, a Social Security Expert at Beijing capital university of economics and business, said China should negotiate and sign social insurance agreements with more countries to avoid double charges for foreign workers and better protect their rights.

新规规定,有资格享受养老金的外国工人,如果已经离开中国,仍可与最近的中国大使馆联系,继续领取养老金。

Under the new rules, eligible foreign workers who have left China can continue to receive pensions by contacting the nearest Chinese embassy.

目前的规定还允许养老金账户中的剩余资金在老人去世后由子女继承。

Current rules also allow the remaining funds in a pension account to be inherited by children after the old person dies.

如果外国工人离开中国后返回工作岗位,他们也可以继续支付社保费用。当账户关闭时,工人可以得到退休金。

Foreign workers can also continue to pay social security if they return to work after leaving China.When the accounts are closed, workers receive a pension.
